These Terms and Conditions (“Terms”) govern your access to and use of the websites, pages, and online services operated by Azusa Pacific University Global (“APU Global,” “we,” “us”). By visiting or using our website, you agree to these Terms. If you do not agree, please do not use the site.
For information about how we collect, use, and protect personal information, see our Privacy Policy.
Eligibility and account use
The site is intended for prospective and enrolled adult learners and other members of the public. If you are given credentials to a student portal, application, or other secured area, you are responsible for keeping those credentials confidential and for all activity that occurs under them. Notify us promptly of any unauthorized use.
Acceptable use
You agree not to:
- Use the site for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to gain unauthorized access to any system, account, network, or data.
- Scrape, harvest, crawl at abusive rates, or use automated means to collect information from the site except as permitted by our robots directives.
- Interfere with or disrupt the site, its security features, or its underlying infrastructure.
- Upload or transmit unlawful, defamatory, harassing, infringing, or malicious content or code.
- Misrepresent your identity or affiliation with APU Global.
Intellectual property
The site and its content—including text, graphics, photographs, video, logos, marks, page design, and software—are owned by APU Global or its licensors and are protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive license to view and download content for personal, non-commercial use. All other use—including reproduction, distribution, modification, or creation of derivative works—requires our prior written permission. The APU Global name, logo, and related marks may not be used without authorization.
Third-party links and services
The site links to third-party websites and services (for example, application platforms, learning systems, payment or financial aid servicers, and social media). We do not control those services, do not endorse their content, and are not responsible for their practices. Your use of a third-party service is governed by that provider’s terms and privacy policy.
Accuracy of program information
We work to keep program, tuition, admissions, financial aid, and accreditation information current, but the site is provided for general informational purposes. Program offerings, curriculum, requirements, tuition and fees, schedules, faculty, and state availability are subject to change. In the event of a conflict between the site and the official Academic Catalog or a signed agreement, the Catalog or agreement controls. Nothing on this site is an offer of admission, a guarantee of financial aid, or a guarantee of employment, licensure, salary, or other outcome.
Disclaimer of warranties
The site and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the site will be uninterrupted, secure, or error-free, or that defects will be corrected.
Limitation of liability
To the fullest extent permitted by law, APU Global and its trustees, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising out of or relating to your use of (or inability to use) the site, even if advised of the possibility of such damages. Our total liability for any claim relating to the site will not exceed one hundred dollars (US $100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Indemnification
You agree to indemnify and hold harmless APU Global and its trustees, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the site, your violation of these Terms, or your violation of any law or the rights of a third party.
Dispute resolution; arbitration and class action waiver
Please read this section carefully; it affects your legal rights. Except for claims that may be brought in small claims court and claims for injunctive relief relating to intellectual property, any dispute arising out of or relating to these Terms or your use of the site will be resolved by binding individual arbitration administered by a nationally recognized arbitration provider under its consumer arbitration rules, before a single arbitrator, in Los Angeles County, California, or remotely at your election. You and APU Global waive the right to a jury trial.
Class action waiver. Disputes must be brought on an individual basis only. You and APU Global agree not to bring or participate in a class, collective, consolidated, or representative action.
Opt-out. You may opt out of this arbitration agreement by sending written notice to contact@apuglobal.edu within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms. This section does not limit rights that cannot be waived under applicable law, including any right to file a complaint with a state agency, accreditor, or the U.S. Department of Education.
Governing law and venue
These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. To the extent a dispute is not subject to arbitration, you and APU Global consent to the exclusive jurisdiction and venue of the state and federal courts located in Los Angeles County, California.
Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted on this page with a revised date. Your continued use of the site after changes are posted means you accept the updated Terms.
Severability
If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will remain in full force and effect.
